WIPO Survey Reveals Concern about Costs of Technology Dispute Proceedings

An International Survey on Dispute Resolution in Technology Transactions conducted by the WIPO Arbitration and Mediation Center reveals that less than 2% of technology agreements lead to formal dispute proceedings, but that these proceedings are generally costly and time-consuming.

The survey report presents the practices and motivation of almost 400 survey respondents from over 60 countries, and assesses the current use and comparative merits of Alternative Dispute Resolution (ADR) methods for resolving technology-related disputes. The survey report also offers observations on dispute resolution best practices based on analysis of the data compiled and interviews conducted with the survey.

Meeting in extraordinary session, the WIPO General Assembly took a landmark decision today to convene a diplomatic conference in 2013 to complete negotiations on a pact to improve access to copyrighted works for the many visually impaired and people with print disabilities around the world.

The General Assembly also expressed gratitude to Morocco for its offer to host the diplomatic conference.

The stage is set for a new international treaty that would extend the protection for audiovisual performers, granting them both economic and moral rights similar to those already recognized for music performers.

Over 500 negotiators from WIPO’s 185 member states, as well as actors, industry and other stakeholder organizations will meet in Beijing from June 20 to 26, 2012 to finalize discussions on an international treaty to update the intellectual property rights of audiovisual performers, such as film and TV actors and actresses. The meeting will be opened on June 20, 2012 at the China World Hotel by WIPO Director General Francis Gurry and high ranking Chinese State and Beijing Municipality officials.

IP Filings Worldwide Rebound in 2010 despite Economic Turmoil

A new report published by WIPO today shows that intellectual property (IP) filings worldwide rebounded strongly in 2010 after a considerable decline in 2009.

The recovery in IP filings was stronger than the overall economic recovery. Patent and trademark filings grew by 7.2% and 11.8% respectively in 2010 compared to growth of 5.1% in the global gross domestic product (GDP), with China and the United States (US) accounting for the greatest share of the increased filings.

WIPO Director General Francis Gurry welcomed a decision today by WIPO’s General Assembly to convene a diplomatic conference in 2012 to agree an international treaty on the rights of performers in their audiovisual performances.

The convening of a diplomatic conference signals entry into the final phase of treaty negotiations.

This is a good day for actors, performers and the international copyright community, Mr. Gurry said. While some countries have domestic legislation that grants certain rights to performers in audiovisual works, there is a legal vacuum at the international level. Performers have not had control over how and when their performances are used abroad, nor any legal right to payment. Today’s decision brings us a big step closer to resolving this question.
