Switzerland: neighbouring right for non original photographs

After 6 years of negotiations, the working group “Lichtibildschutz” (of which CEPIC member SAB is a member) has been successful in getting created a “neighbouring right” for photographs lacking the necessary level of originality to be protected by authors rights.

In the future, photographs will be protected works regardless of their “individual originality”.
Thus, in Switzerland the law recognises what is obvious to any fair users: those who wants to use a picture of a third party beyond private use should first get the consent of the author.” writes the press communication here …
